Apple is hit with its first-class lawsuit as a result of the Siri recordings that were passed on to contractors to listen to. The case was first discovered by Kid Lewsing and the lawsuit was brought in the federal court of Northern California.
The lawsuit goes after Apple for failing to disclose this practice to users and offering its own choice.
no point gave plaintiffs consent to these illegal recordings. Apple does not disclose that Siri Devices record calls that are not given a wake-up call or gesture. Plaintiffs Lopez and A.L. therefore did not agree to be registered by the Siri units respectively. Also, Apple could not have obtained the consent of Plaintiff AL, a minor without an Apple account.
The lawsuit also points out that Apple is trying to differentiate itself from Facebook, Amazon and Google with its first approach to privacy, but that is not really the case as the failure has shown.
Apple has sought to differentiate itself from competing technology companies such as Facebook, Amazon, and Apple who have been involved in scandals involving the collection, sharing or sale of user data by showing privacy protections. If a person asked Siri "Hi Siri, are you always listening", Siri is programmed to answer: "I only listen when you talk to me."
Plaintiff goes on to argue that if users wanted to use Apple devices in the future, how would they be sure that this practice is no longer happening.
Plaintiffs would like to continue using Siri devices in the future, but will be uncertain whether Apple ceased illegal practice and infringement of their privacy rights without the fair relief requested here, more specifically, an injunction prohibiting Apple from participating in Unlawful Procedures Claimed Here
